Hon'ble Sir. With due respect your applicant wants to
draw kind attention of Hon'ble Sir towards following submissions as
follows. 1-It is submitted before the Hon'ble Sir
that letter no. 1756/P-7/RTI/2011-12 dated 23.12.2011 addressed to
your applicant by D.P.R.O. Mirzapur is mockery of U.P.S.I.C. 2-It
is submitted before the Hon'ble Sir that D.P.R.O. Mirzapur took the
recourse of letter no. Memo/P-7/RTI/dated 11.5.2011 and letter no.
477/P-7/dated 27.6.2011 which were earlier submitted before U.P.S.I.C.
but Hon'ble commission did not accept those submissions of D.P.R.O.
Mirzapur. 3-It is submitted before the Hon'ble Sir that
D.P.R.O. Mirzapur is only making procrastinating efforts. Whatever
manipulation was made with the records of D.P.R.O. Office carriedout
with the consent of D.P.R.O. Mirzapur as ipsofacto obvious. Now
D.P.R.O. Mirzapur is in state of dilemma that if he made available the
sought information, he will have to lodge F.I.R. against his
subordinates. 4-It is submitted before the Hon'ble Sir
that D.P.R.O. Mirzapur is stating in its letters that only copy of
letters can be sought under R.T.I. Act 2005. This statement of
D.P.R.O. Mirzapur is against the provisions of R.T.I. Act 2005.
D.P.R.O. Mirzapur is not competent to make rules under R.T.I. Act
2005. This is humble request of your applicant to you
Hon'ble Sir to take penal action against D.P.R.O. Mirzapur. To give
more opportunity to D.P.R.O. Mirzapur to made available information is
in itself violation of provisions of R.T.I. Act 2005. For this your

inform you Hon'ble Sir that representative of PIO Mirzapur ie
A.D.P.R.O. Mirzapur always make pretext in providing sought
information like what action has been taken by D.M. Mirzapur on the
letter of your applicant dated 14.12.2008 addressed to Hon'ble Prime
Minister of India forwarded to chief secretary government of uttar
pradesh then through appropriate chanels ultimately reached to D.M.
Mirzapur who is the authority concerned and which date will be
accepted by the government of U.P. as the nomination of enquiry
officer because enquiry officer itself accepted in different letters
that he was nominated enquiry officer by D.M. Mirzapur on 31.5.2006
but D.P.R.O. Mirzapur by manipulating the aforesaid date into
31.5.2007 informed your applicant that date of nomination of enquiry
officer is 31.5.2007. D.P.R.O. Mirzapur not only manipulated the date
on letter of nomination of enquiry officer but also manipulated the
date on enquiry report submitted by enquiry officer. This act of
D.P.R.O. Mirzapur tantamount to offence like committing forgery with
the public records. Several senior rank authorities have written
letter to D.M. Mirzapur as well as complaint is being heard by
U.P.S.I.C. since more than one and half year but no fruitful result
could be reaped. It seems that forgery with records of public or
records of court has been common pratice now a days.
This is humble request of your applicant to you Hon'ble Sir to
direct appropriate authorities to follow the rule of law and don't
create obstacle in the path of a public spirited citizen of the
country performing his fundamental duties prescribed under article 51A
of the constitution of India. For this your applicant shall ever pray

draw the kind attention of Hon'ble Sir that next date hearing has been
fixed on 11 january 2012 when A.D.P.R.O. Mirzapur did not furnish
access to information on filmsy grounds on date fixed on 19 october
2011. It is submitted before the Hon'ble Sir that D.P.R.O. Mirzapur
forged all concerned documents by manipulating date of nomination of
Enquiry officer ie31.5.2006 was manipulated to 31.5.2007 but it is
unfortunate that D.P.R.O. Mirzapur couldn't do as such in the
concerned records of minor irrigation and consequently special
secretary government of uttar pradesh minor irrigation Mr. Usha Raman
Tripathi categorically quoted in its letter addressed to staff officer
that matter is concerned with department of panchayat and D.M.
Mirzapur not minor irrigation. On the basis of these forged documents
gram pradhan Vill-Nibi Gaharwar Block-Chhanbey instituted a complaint
in the court of A.C.J.M. Mirzapur against your applicant but when your
applicant raised the same question in the court then A.C.J.M. Mirzapur
on 12.6.2008 summoned original copy of both the letters ie letter of
nomination of enquiry officer and enquiry report but not complied by
D.P.R.O. Mirzapur. This is humble request of your
applicant to you Hon'ble Sir to direct D.P.R.O. Mirzapur to follow
rule of law not to try to be above law. For this your applicant shall

kind attention of Hon'ble Sir that your applicant's letter petition
addressed to Hon'ble Prime Minister of india Dr. Manmohan Singh dated
14.12.2008 forwarded to chief secretary, government of uttar pradesh
for action as appropriate. Consequently aforesaid letter was sent to
D. M. Mirzapur to take action. It is submitted before the Hon'ble Sir
that instead of furnishing access to information to your applicant by
the D. M. Mirzapur that what action has been taken on the aforesaid
letter as sought under subsection 1 of section 6 of R.T.I. Act 2005,
D.M. Mirzapur forwarded the letter to D.P.R.O. Mirzapur and he filed
the letter in non movable files as usual. It is submitted
before the Hon'ble Sir that even after 10 hearings in commission
D.P.R.O. Mirzapur only made available that queries can not be asked
under R.T.I. Act 2005 as mentioned you have not sought copy of any
records but you have queried which is not in accordance with R.T.I.
Act 2005. It is submitted before the Hon'ble Sir that now my
aforesaid letter has been part of documents of D.P.R.O. Mirzapur
office and what is its fate your applicant can know under transparency

the department to made available access to information in detail that

available information point-wise within time stipulated under

solid and strong steps were taken by D.M. Mirzapur which shows the
sheer procrastination on the part of district administration. This
also shows the lackadaisical approach of D.M. Mirzapur towards the
letters of Government of Uttar Pradesh as ipsofacto obvious.
4-It is submitted before the Hon'ble Sir that when the
ray of hope diedout then your applicant filed second appeal before
U.P.S.I.C. under subsection 3 of section 19 of R.T.I. Act 2005.
Initially district administration did not attend the proceedings. Then
it said that all the informations have been made available already.
Again they took the recourse of pretext that concerned documents have
been submitted to the A.C.J.M. Court Mirzapur which proved wrong by
your applicant. When there remained no alternative then D.P.R.O.
Mirzapur made available a bogus information through its letter no. 477
dated 27.6.2011 in which your applicant's letter dated 14.12.2008
addressed to Prime Minister of India was considered as R.T.I. letter.
D.P.R.O. Mirzapur replied under six points and each contained the same
content as in this question ,no photo copy of any letter has been
sought therefore not in accordance with R.T.I. Act 2005. It is
unfortunate that D.P.R.O. Mirzapur can not even recognize an R.T.I.
Application . This is my humble request to you Hon'ble Sir to
direct authorities concerned to respect at least the letter of
P.M.O. & take apprpriate steps in accordance with law. For this your
applicant shall ever pray you Hon'ble Sir. Yours sincerely Yogi M.

My Mission Statement is:

A lot of people have written in asking why do I write these articles?

My answer is simple.

We meet loads of people everyday. When we stand around talking a lot of issues are discussed, what I hope and see happening is that the next time one of the readers starts a conversation on a topic I have written about, at least they will talk about it from a new viewpoint from the rest.

Which is why I talk about all aspects on life in India be it the Ram Setu Bridge or the Elections or maybe even the latest soap on TV.
