{Awareness} Taking Care of Your Thoughts

 



When surrounded by challenges, sometimes we all need a little extra nurturing, and that gentleness can come from loved ones, or just from ourselves. Also, enjoying the hot chocolate and the coffee, enjoying the cold drink and the ice cream, enjoying the brisk walk and the gym, enjoying the picnic and the party, enjoying the holiday - these are all things that help us replenish our energy and remain motivated to some extent when we've had a rough day.

 But remember that to remain constantly motivated you need to also take a look at the non-physical dimension of thoughts and feelings. Physical treatments, therapies and relaxation strategies will help you but they cannot change the way you think. Your thinking is the cause. And behind your thoughts, your beliefs are a deeper cause.

We need to pay much more attention to our thoughts and feelings, learn to manage them, learn to fill them with peace and calm, and then our personality will change for the better, as we restore our mental and then physical well-being and learn to remain motivated and fearless amidst challenges.


Remember no one else creates our thoughts and feelings, and they don't just happen, though it feels that way sometimes. When you learn to identify and assess the quality of your thoughts and feelings, you can begin to choose the ones you know are positive and that in turn keeps you motivated.

Also, remember there's virtually always something positive that can be found in the challenges we face. Bear in mind that the period of challenge is short and you will soon overcome the challenge. On a lighter note, spend a little time each day thinking of all the things you are looking forward to doing once you are free from these exams that life has to offer - though don't daydream for hours about this! Also, when you long for life without difficulties and challenges and you want to keep yourself motivated when faced with them, remind yourself that oaks grow strong in contrary winds and diamonds are made under pressure. Challenges are not here to stay and while they are there, they bring about self empowerment.

Medical experts, economists and educators believe that better and easier access to healthcare could be possible if the state fulfills its responsibility and people willingly pay their taxes.

The Aga Khan University (AKU) organised a panel discussion, titled 'The Ethics and Economics of Healthcare in 21st Century' on Thursday as part of AKU's Sixth Sense Forum lecture series.

"The state is inefficient. It has withdrawn from its responsibilities," said Dr Akbar Zaidi, an economist. "It has withdrawn even from governance," he lamented. He said that due to the absence of the government's institutions, people who cannot afford to pay their medical bills are given access to healthcare facilities by charitable organisations.

Justifying his point of view on political activism, Dr Zaidi said that Punjab and Khyber-Pakhtunkhwa are the best examples of provinces where health facilities are being provided to citizens. "In Sindh, no one cares." He said that political competition is very essential and it is time to put pressure on political parties to perform as well.

"Patient care is the primary responsibility," said Dr Aamir Jafarey, an associate professor at the Centre of Biomedical Ethics and Culture of the Sindh Institute of Urology and Transplantation (SIUT). He claimed that physicians are managers, thereby creating a conflict of interest.

Dr Jafarey said that a patient is considered a client or a customer. "It is also in my [a doctor's] interest if I provide better treatment to a patient. There is always a trust relationship between a doctor and a patient," he maintained.

Dr Jafarey said that there are several organisations with success stories such as the AKUH and SIUT, which set standards for others to follow. Those who want to deliver should continue their struggle, no matter what the naysayers say, he added.

Dr Zaidi said that the private sector has been involved in the health and education sectors for some time. He said that 60 per cent of the population in Pakistan is urban but the urban services are available for only those who can afford them. He also pointed out that there is little research in the country's health sector. "The real challenge is outreach," pointed out Hans Kedzierski, AKUH chief executive officer. He said that there is diversity everywhere in Pakistan. "Pakistan is a great country," he said, predicting that the generation striving for the progress of the country will definitely deliver.

Lab tests: Damned if you do, damned if you don't

Were you to compare the number of prescriptions written and the number of lab requests ordered by the doctor, the latter almost always edge in front. Medical professionals argue that there is collusion in Pakistan (and possibly elsewhere in the world) between doctors and diagnostic facilities, which may contribute to the gamut of tests, scans and screenings that a patient is prescribed.

"For tests ordered, doctors are known to get a cut from diagnostic facilities," says Dr Sania Nishtar, head of Heartfile, an Islamabad based organisation that strives to change Pakistan's health systems. "This incentive-sharing mechanism, while not kosher, is almost 'official'."

"It's quite common, and is quite institutionalised," adds Dr Amjad Siraj Memon, a professor of surgery at Karachi's Civil Hospital. He says most doctors are reportedly involved in getting a certain percentage from the tests they order from a particular lab. "There are PROs hired by labs who go shopping for doctors with whom they can strike a business deal."

But these "kick back arrangements" are also made with hospitals, diagnostic machine owners as well as pharmaceutical companies and reflects the "decadence of our society" from which those doctors emerge, points out Dr Tasnim Ahsan, former executive director of Jinnah Post-Graduate Medical Centre (JPMC), where she worked for 24 years. However, she claims that the number of such "rogue" practitioners was small.


When and why are lab tests ordered? Are these too many? But more importantly, are they the right ones and has it led to better health care and diagnosis?


There is a public perception that doctors are ordering often unnecessary tests that are far too pricey and then sending patients to specialists without considering the scientific rationale for getting these tests done. Many attribute it to the medical profession growing increasingly avaricious and unscrupulous.

But to understand whether doctors are ordering too many unnecessary tests and treatments and why, medical professionals explain that these should be viewed in the context of the particular system the doctor works in.

"In the US," explains Nishtar, "there is a strong culture of recourse to litigation so as to enforce professional liability claims. Hence the doctors may tend to order more tests than may be required."

At the same time, there is a continuous tussle between insurance companies who want fewer tests (on patients since they are covered under insurance schemes) and doctors who want to order more tests (both for reimbursements from hospitals and to protect themselves from expensive suits filed against them for malpractice).

In the British system, on the other hand, the state provides free healthcare and "there the focus of the doctors is less tests so as not to overburden the system," Nishtar remarked.

In Pakistan, Ahsan explains, the country has a completely bifurcated system for healthcare.

"The poor attend under-funded and over-burdened dysfunctional government hospitals. Doctors working and training in these hospitals learn to treat patients with limited investigations and drugs. But large private hospitals and teaching centres like to work as if they are in America," she says.

"And the fear of being held responsible for malpractice is not always a factor since the 'tort' (a civil wrong that unfairly causes someone else to suffer loss or harm resulting in legal liability for the person who commits the tortious act) law is not fully developed," says Nishtar, whose organisation provides financial support to those who are too poor to access healthcare and therefore has seen the working of the hospitals at close quarters.

Faisal, a public health practitioner heading Arjumand & Associates, an Islamabad-based consultancy group who offer their services to governments, universities and research institutions, argues that such practices merely reflect our social mores, since doctors are part of the same society that we all belong to.

However, he says, young doctors today are "not trained to diagnose based on their clinical skills." Poor teaching and not keeping their professional knowledge and skills up to date is often accompanied with the greed to make more money, he explains.

Dr Inayat Thaver, a health and population advisor at Mustashaar, a group of experts who offer technical and management services in the social and development areas with a special focus on health and population issues, concurs. "Compared to the good old physicians of yore, the new graduates prefer diagnosis by exclusion, rather than confirming the diagnosis by reaching a provisional diagnosis using their clinical skills," he says.

These practices persist despite there being "practice guidelines" from reputed medical institutions which are regularly updated, based on emerging and new evidence from research. "These are considered the international standard of care for a particular disease," explains Dr Ahsan.

"But few follow these SOPs and fewer still have confidence in their diagnosis," says Faisal, as that requires meticulous history-taking and careful examination, which takes up a lot of time.

Having practiced as a doctor at Karachi's Aga Khan University Hospital (AKUH) for well over 15 years, he recalls that when he was incharge of the community health sciences there, he ensured each junior doctor saw three patients, at the most, in one hour. "After seeing 12 patients in four hours, they had to take time off and refresh themselves before seeing the next batch," he says.

But sometimes it is difficult to distinguish when what was judged by the doctor to be an important test later turned out to be unnecessary. At times, doctors order tests because they worry about missing but possible illness. There is, therefore, a need to check whether the diagnosis holds.

Conceding that there is just anecdotal evidence, Nishtar says that in the absence of a quality regulatory mechanism and scientific evidence, it was very difficult to say if there actually was "overconsumption" of diagnostics.

Defending her colleagues, Ahsan argues that doctors have to walk a tightrope as far as ordering investigations are concerned. "You are damned if you do and damned if you don't." This, she says, was especially true in an emergency where many things have to be ruled out quickly, in order to take a timely treatment decision to save a life.

And to be fair to her fraternity, she added that doctors inherently tend to "over- investigate" in order to not hold themselves responsible, "within their own minds", for harming a patient as a result of "meagre investigative data".

At the same time, says Ahsan, "the narrative that remains missing from these kinds of discussions is the life-time stress that doctors suffer from, on account of being responsible for somebody else's life and meaningful survival."

Lamenting the utterly "callous attitude at health centres", she says it is further compounded by poverty and illiteracy.

"People are completely unaware of their basic rights in a climate of tolerating malpractice," she says and concluded: "Reform won't happen as certain cartels of doctors won't like any kind of regulation placed on them."

कार्मिकों द्वारा पद का दुरुपयोग कर सरकार से छल करने के प्रयोजन से
तथ्यों को छुपाकर और कूटरचना कर मिथ्या दस्तावेज बनाकर जारी करके सरकार

इन सभी ने भ्रष्टाचार में लिप्त होकर व्यक्तिगत अभिलाभ प्राप्त करने के
लिए अपने पदीय अधिकारों का दुरुपयोग करते हुए यूपी सरकार के साथ छल किया
है और माननीय उच्च न्यायालय, उच्चतम न्यायालय के आदेशों समेत अनेकों
कानूनी व प्रशासनिक तथ्यों को छुपाकर कूटरचना द्वारा मिथ्या दस्तावेज
बनाकर जारी करने का अपराध करके सरकार को आर्थिक क्षति कारित की है l यह
कूटरचित दस्तावेज उत्तर प्रदेश समाज कल्याण अनुभाग-1 का कार्यालय ज्ञाप
संख्या 3783/26-1-2014-119(70)/02 लखनऊ दिनांक 04 दिसम्बर 2014 है l

इस कूटरचित दस्तावेज के माध्यम से विभाग की संस्था राजकीय गोविन्द बल्लभ
पन्त पॉलिटेक्निक मोहान रोड लखनऊ के कार्मिक पवन कुमार मिश्रा को उच्च
न्यायालय लखनऊ खंडपीठ की याचिका संख्या 110/एसबी/2004 के आदेश दिनांक
24-02-06, सर्वोच्च न्यायालय की याचिका संख्या SLP(C ) No. 7096/2008 के
आदेश दिनांक 01-02-2008 , उच्च न्यायालय लखनऊ खंडपीठ की याचिका संख्या
1735/एसबी/2010 के आदेश दिनांक 24-11-10,विभाग की सेवा नियमावली और
विनियमितीकरण नियमावली के उपबन्धों के प्रतिकूल जाकर द्वितीय श्रेणी के
राजपत्रित पद पर विनियमितीकरण करके विपक्षीगणों द्वारा राज्य सरकार को
आर्थिक क्षति कारित की गयी है l यह अपराध न्यायालयों के उपरोक्त तीनों
आदेशों द्वारा दिए गए इस कानूनी आदेश के बाद किया गया है कि तदर्थ रूप से
नियुक्त न होने के कारण पवन कुमार मिश्रा का विनियमितीकरण किया ही नहीं
जा सकता है l मिथ्या दस्तावेज बनाकर जारी करने के इस अपराध को कारित करने
में इस प्रशासनिक तथ्य को भी छुपाया गया है कि पवन कुमार मिश्रा कर्मशाला
अधीक्षक पद के लिए विभाग की सेवा नियमावली में विहित आवश्यक अर्हता 3
वर्ष का अनुभव धारित ही नहीं करता है और उ० प्र० ( लोक सेवा आयोग के
क्षेत्रान्तर्गत पदों पर ) तदर्थ नियुक्तियों का विनियमितीकरण नियमावली
1979 एवं संशोधित नियमावली 2001 के नियम 4(1)(दो) के अनुसार 3 वर्ष का
अनुभव धारित न करने के कारण पवन कुमार मिश्रा को इस पद पर विनियमित किया
ही नहीं जा सकता है l इस प्रकार विपक्षीगणों ने न्यायालय के आदेश को अपने
प्रशासनिक आदेश से पलटने का अपराध भी कारित किया है l पवन कुमार मिश्रा
लखनऊ की अवध इंडस्ट्रीज का मात्र 2 वर्ष 7 माह 22 दिन का अनुभव ही धारित
करता है जो 3 वर्ष से कम है l

यही नहीं विपक्षीगण उपरोक्त द्वारा इस जघन्य अपराध को कारित करने में
उच्च न्यायालय लखनऊ खंडपीठ की याचिका संख्या 400/एसबी/2013 के आदेश
दिनांक 02-04-13 के अनुपालन में उत्तर प्रदेश समाज कल्याण अनुभाग-1
द्वारा जारी कार्यालय ज्ञाप संख्या 1280/26-1-2013-119(72)/2006 लखनऊ
दिनांक 02 जुलाई 2013 के तथ्यों को भी छुपाया गया हैl इस आदेश द्वारा
समाज कल्याण के तत्कालीन प्रमुख सचिव संजीव दुबे ने आदेश जारी कर कहा था
कि पवन कुमार मिश्रा के विनियमितीकरण पर विचार किया जाना संभव नहीं था और
पवन द्वारा विनियमितीकरण के सम्बन्ध में दिया गया प्रत्यावेदन निरस्त कर
दिया था l

आप से अनुरोध है कि उत्तर प्रदेश समाज कल्याण विभाग के प्रमुख सचिव सुनील
कुमार (आई० ए० एस०), उप सचिव राज कुमार त्रिवेदी एवं उत्तर प्रदेश
सचिवालय के अन्य कार्मिकों द्वारा पद का दुरुपयोग कर सरकार से छल करने के
प्रयोजन से तथ्यों को छुपाकर और कूटरचना कर मिथ्या दस्तावेज बनाकर जारी
करके सरकार को आर्थिक क्षति कारित करने के जालसाजी और धोखाधड़ी के इस
संज्ञेय अपराध के मामले में उत्तर प्रदेश के प्रमुख सचिव समाज कल्याण
सुनील कुमार तथा उप सचिव राज कुमार त्रिवेदी को तत्काल निलंबित कर प्रकरण
की जांच सीबी-सीआईडी से कराकर सभी दोषियों को दण्डित कराने की नियमपूर्ण
कार्यवाही तत्काल कराने का कष्ट करें l

दण्डित कराने की मांग करते हुए आज लखनऊ के लक्ष्मण मेला मैदान स्थित धरना
स्थल पर हुंकार भरी l

धरने का आयोजन येश्वर्याज सेवा संस्थान ने किया था l धरने में तनवीर अहमद
सिद्दीकी, ज्ञानेश पाण्डेय,हरपाल सिंह,राम स्वरुप यादव,होमेंद्र पाण्डेय
समेत अनेकों सामाजिक कार्यकर्ताओं ने हिस्सा लिया l

येश्वर्याज की सचिव उर्वशी शर्मा ने बताया कि उत्तर प्रदेश समाज कल्याण
विभाग के प्रमुख सचिव सुनील कुमार (आई० ए० एस०) और उप सचिव राज कुमार

स्थापित कर सरकार से ही छल कर डाला और तथ्यों को छुपाकर कूटरचना करके
मिथ्या दस्तावेज बनाकर जारी किये और सरकार को आर्थिक क्षति कारित करने का
अपराध किया l बकौल उर्वशी इन सभी ने भ्रष्टाचार में लिप्त होकर अनेकों

के प्रतिकूल जाकर द्वितीय श्रेणी के राजपत्रित पद पर विनियमितीकरण करके
विपक्षीगणों द्वारा राज्य सरकार को आर्थिक क्षति कारित की गयी है l यह
अपराध न्यायालयों के उपरोक्त तीनों आदेशों द्वारा दिए गए इस कानूनी आदेश
के बाद किया गया है कि तदर्थ रूप से नियुक्त न होने के कारण पवन कुमार
मिश्रा का विनियमितीकरण किया ही नहीं जा सकता है l मिथ्या दस्तावेज बनाकर
जारी करने के इस अपराध को कारित करने में इस प्रशासनिक तथ्य को भी छुपाया
गया है कि पवन कुमार मिश्रा कर्मशाला अधीक्षक पद के लिए विभाग की सेवा
नियमावली में विहित आवश्यक अर्हता 3 वर्ष का अनुभव धारित ही नहीं करता है
और उ० प्र० ( लोक सेवा आयोग के क्षेत्रान्तर्गत पदों पर ) तदर्थ
नियुक्तियों का विनियमितीकरण नियमावली 1979 एवं संशोधित नियमावली 2001 के
नियम 4(1)(दो) के अनुसार 3 वर्ष का अनुभव धारित न करने के कारण पवन कुमार
मिश्रा को इस पद पर विनियमित किया ही नहीं जा सकता है l इस प्रकार
विपक्षीगणों ने न्यायालय के आदेश को अपने प्रशासनिक आदेश से पलटने का
अपराध भी कारित किया है l पवन कुमार मिश्रा लखनऊ की अवध इंडस्ट्रीज का
मात्र 2 वर्ष 7 माह 22 दिन का अनुभव ही धारित करता है जो 3 वर्ष से कम है
l

उर्वशी का कहना है कि केवल इतना ही नहीं, इन लोगों ने इस जघन्य अपराध को
कारित करने में उच्च न्यायालय लखनऊ खंडपीठ की याचिका संख्या
400/एसबी/2013 के आदेश दिनांक 02-04-13 के अनुपालन में उत्तर प्रदेश समाज
कल्याण अनुभाग-1 द्वारा जारी कार्यालय ज्ञाप संख्या
1280/26-1-2013-119(72)/2006 लखनऊ दिनांक 02 जुलाई 2013 के तथ्यों को भी
छुपाया गया हैl इस आदेश द्वारा समाज कल्याण के तत्कालीन प्रमुख सचिव
संजीव दुबे ने आदेश जारी कर कहा था कि पवन कुमार मिश्रा के विनियमितीकरण
पर विचार किया जाना संभव नहीं था और पवन द्वारा विनियमितीकरण के सम्बन्ध
में दिया गया प्रत्यावेदन निरस्त कर दिया था l

उर्वशी ने बताया कि आज के धरने के बाद उपस्थित समाजसेवी मुख्यमंत्री आवास
जाकर उनको अपनी मांगों से सम्बंधित ज्ञापन सौपेंगे और अगर सरकार ने
प्रमुख सचिव और उप सचिव स्तर के अधिकारियों द्वारा भष्टाचार के लिए
जालसाजी करने के इस मामले में त्वरित कार्यवाही कर दोषियों को दण्डित
नहीं किया तो वे शीघ्र ही इस मामले को लोकायुक्त के समक्ष पेश करेंगीं l
