Hon'ble Sir. With due respect your applicant wants to
draw the kind attention of Hon'ble Sir towards following submissions
as follows. 1-It is submitted before the Hon'ble
Sir that your applicant submitted aforesaid appeal to pass an
appropriate order so that B.D.O. Chhanbey, Mirzapur (U.P.) made
available desired information to your complainant as sought through
the letter dated 21.11.2010 from C.D.O. Mirzapur in accordance with
the provisions of R.T.I. Act 2005. Your applicant also requested to
pass an appropriate order in accordance with the provisions of R.T.I.
Act 2005 so that B.D.O. Chhanbey Dist-Mirzapur(U.P.) may not dare
again to furnish misleading and incomplete information. This
communique was sent on the same date by speed registered post to
U.P.S.I.C. by your applicant with annexures. This appeal contained
submissions under 8 points in five pages originally and annexure 1 in
five pages, annexure 2 in three pages, annexure 3 , annexure 4 in four
pages, annexure 5, annexure 6 in three pages and annexure 7 in three
pages. 2-It is submitted before the Hon'ble Sir that a
supplementary petition to aforesaid appeal was submitted by your
complainant on 21.6.2011 addressed to Hon'ble Chief Information
Commissioner , Government of Uttar Pradesh, Indira Bhawan, sixth
floor, Lucknow (U.P.) WITH PRAYER THAT Hon'ble Sir may be pleased to
connect this supplementary with the appeal of Your complainant dated
21 march 2011 filed in S.I.C. under subsection 3 of section 19 of
R.T.I. Act 2005. This is humble prayer of your complainant to direct
B.D.O. Chhanbey to made available rest of information and not to take
provisions of R.T.I. Act 2005 under teeth. B.D.O. Chhanbey, Mirzapur
not only made the procrastinating efforts in dealing an R.T.I.
Communique as well as misled repeatedly to your complainant. This
supplementary was sent on the same date by your complainant through
speed registered post.
SUBMISSIONS OF SUPPLEMENTARY ARE AS FOLLOWS. 1-It is
submitted before the Hon'ble Sir that your complainant submitted an
appeal dated 21march2011 under subsection 3 of section 19 of R.T.I.
Act 2005 to pass an appropriate order so that B.D.O. Chhanbey,
Mirzapur made available desired information to your complainant as
sought through the letter dated 21.11.2010 from C.D.O. Mirzapur.
Hon'ble Sir may be pleased to take the perusal of annexure 1 in five
pages. 2-It is submitted before the Hon'ble Sir that your
complainant received a letter on 26.3.2011 sent by B.D.O. Chhanbey
through registered post dated 10.3.2011 in which B.D.O. Chhanbey
alleged that your complainant is not interested in seeking information
instead more interested in finding and proving system faulty but did
not furnish supportive evidence in regard to allegation. Hon'ble Sir
may take a glance of annexure 2. 3-It is submitted
before the Hon'ble Sir that your complainant submitted the reply of
letter dated 10.3.2011 through the letter dated 27.3.2011 with the
prayer that irksome delay by B.D.O. Chhanbey in providing information
shows a lackadaisical approach towards official duty on the part of
B.D.O. Chhanbey, before P.I.O. Mirzapur. PIO Mirzapur was also
informed that B.D.O. Chhanbey through its letter dated 27.1.2011 made
available list of selected beneficiaries (elligible villagers who may
be benefitted through scheme based on survey reports). Even these
computer copies are not certified to prove the authenticity of the
list as required by law. Ipsofacto obvious from the perusal that no
other documents are contained in the letter. Consequently baseless
allegation was made by the B.D.O. Chhanbey against your complainant.
It is unfortunate that list of allottees and grants provided them was
not made available. Hon'ble Sir may be pleased to take the perusal of
annexure 3 in three pages. 4-It is submitted before the
Hon'ble Sir that aforesaid letter dated 27.3.2011 was received in the
office of PIO Mirzapur on 30.3.2011 and forwarded to B.D.O. Chhanbey
with covering letter without bearing date and letter no. with
direction to made available desired information to your complainant.
Hon'ble Sir may be pleased to take the perusal of annexure 4. It is
unfortunate that B.D.O. Chhanbey who think himself above law in
schizophrenic way did not deem it fit to take any action on the letter
of PIO Mirzapur which shows the sheer disregard towards the R.T.I. Act
2005 on the part of B.D.O. Chhanbey. This is humble
request to you Hon'ble Sir to direct appropriate authority to made
available list of allottees and grants provided to them. For this your
applicant shall ever pray you Hon'ble Sir. Yours
