Hon'ble Sir. With due respect your applicant wants to
draw kind attention of Hon'ble Sir towards following submissions as
follows. 1-It is submitted before the Hon'ble Sir
that letter no. 1756/P-7/RTI/2011-12 dated 23.12.2011 addressed to
your applicant by D.P.R.O. Mirzapur is mockery of U.P.S.I.C. 2-It
is submitted before the Hon'ble Sir that D.P.R.O. Mirzapur took the
recourse of letter no. Memo/P-7/RTI/dated 11.5.2011 and letter no.
477/P-7/dated 27.6.2011 which were earlier submitted before U.P.S.I.C.
but Hon'ble commission did not accept those submissions of D.P.R.O.
Mirzapur. 3-It is submitted before the Hon'ble Sir that
D.P.R.O. Mirzapur is only making procrastinating efforts. Whatever
manipulation was made with the records of D.P.R.O. Office carriedout
with the consent of D.P.R.O. Mirzapur as ipsofacto obvious. Now
D.P.R.O. Mirzapur is in state of dilemma that if he made available the
sought information, he will have to lodge F.I.R. against his
subordinates. 4-It is submitted before the Hon'ble Sir
that D.P.R.O. Mirzapur is stating in its letters that only copy of
letters can be sought under R.T.I. Act 2005. This statement of
D.P.R.O. Mirzapur is against the provisions of R.T.I. Act 2005.
D.P.R.O. Mirzapur is not competent to make rules under R.T.I. Act
2005. This is humble request of your applicant to you
Hon'ble Sir to take penal action against D.P.R.O. Mirzapur. To give
more opportunity to D.P.R.O. Mirzapur to made available information is
in itself violation of provisions of R.T.I. Act 2005. For this your

follows. 1-It is submitted before the Hon'ble
Sir that hearing took place before the uttar pradesh state information
commission on 19 october 2011. It is unfortunate that A.D.P.R.O.
Mirzapur who made submissions on behalf of PIO Mirzapur could not made
available information that what action was taken by D.M. Mirzapur on
my letter dated 14.12.2008 forwarded to chief secretary government of
U.P. by P.M.O. for action as apprpriate. 2-It is
submitted before the Hon'ble Sir that next date of hearing has been
fixed on 11 january 2011 by U.P.S.I.C. with the direction to the
concern to made available information. 3-It is submitted before the
Hon'ble Sir that repeated hearing is takingplace before the U.P.S.I.C.
since two years but no sought information was made available by PIO
Mirzapur. 4-It is submitted before the Hon'ble Sir
that why district administration Mirzapur is undermining the authority
of U.P.S.I.C. and U.P.S.I.C. is not taking penal action against the

of U.P. has adopted lackadaisical approach in dealing with the letter

Hon'ble Sir. Please take the perusal of rest of submissions in
respect of earlier submitted. Hon'ble Sir may be
pleased to take the perusal of annexure 2. Please direct P.I.O. of
the department to made available access to information in detail that
what action you have taken on the letter dated 14.12.2008 in

submitted before the Hon'ble Sir that meanwhile more than half a dozen
were written to D.M. Mirzapur by Government of Uttar Pradesh but no
solid and strong steps were taken by D.M. Mirzapur which shows the
sheer procrastination on the part of district administration. This
also shows the lackadaisical approach of D.M. Mirzapur towards the
letters of Government of Uttar Pradesh as ipsofacto obvious.
4-It is submitted before the Hon'ble Sir that when the
ray of hope diedout then your applicant filed second appeal before
U.P.S.I.C. under subsection 3 of section 19 of R.T.I. Act 2005.
Initially district administration did not attend the proceedings. Then
it said that all the informations have been made available already.
Again they took the recourse of pretext that concerned documents have
been submitted to the A.C.J.M. Court Mirzapur which proved wrong by
your applicant. When there remained no alternative then D.P.R.O.
Mirzapur made available a bogus information through its letter no. 477
dated 27.6.2011 in which your applicant's letter dated 14.12.2008
addressed to Prime Minister of India was considered as R.T.I. letter.
D.P.R.O. Mirzapur replied under six points and each contained the same
content as in this question ,no photo copy of any letter has been
sought therefore not in accordance with R.T.I. Act 2005. It is
unfortunate that D.P.R.O. Mirzapur can not even recognize an R.T.I.
Application . This is my humble request to you Hon'ble Sir to
direct authorities concerned to respect at least the letter of
P.M.O. & take apprpriate steps in accordance with law. For this your
applicant shall ever pray you Hon'ble Sir. Yours sincerely Yogi M.
