Hon'ble Sir. Your applicant wants to draw kind
attention of Hon'ble Sir towards following submissions as follows.
1-It is submitted before the Hon'ble Sir that
complaint number S-11-169/C/2009 filed by your applicant has been
fixed for hearing on 1.8.2012 as next date by information commission.
2-It is submitted before the Hon'ble Sir that D.P.R.O.
Mirzapur through its letter no.393/पँ0-7/RTI/2012-13 dated 30.5.2012
adressed to your applicant and served to Mr Ram Rekha Pandey under
secretary/PIO Panchayat raj section-1, government of uttar pradesh,
lucknow informed complaint year 2010 which is sheer misleading fact
and an attempt conceal the actual fact of the case.
3-It is submitted before the Hon'ble Sir that notice sent by
information commission through its letter no. 12091 /SIC/08 Dated
04.03.2010 complaint no. S-11-169/C/09 , Yogi M. P. Singh versus D.M.
Mirzapur. 4-It is submitted before the Hon'ble Sir that some times
D.P.R.O. says that sought information have been made available then
required document have been submitted to A.C.J.M. Court Mirzapur and
then you have asked query and you have not sought any photocopy of
documents so not in accordance with the provision of R.T.I. Act 2005.
5-It is submitted before the Hon'ble Sir that
D.P.R.O. is quasijudicial authority as he is SPIO of his department
so section 4(1)(d) must be followed by him. 6-It is submitted
before the Hon'ble Sir that SPIO can deny information only under
section 8 and 9. 7-It is submitted before the Hon'ble Sir that
commission is considering the case under subsection 3 of section 19
which is latter stage and at this stage he should argue the case on
the basis of earlier correspondence and information commission must
impose pecuniar penalty on him under section 20. Surprisingly
U.P.S.I.C. has sweared not to impose pecuniar penalty if imposed ,
public authority will not recover it. 8-It is submitted
before the Hon'ble Sir that I know it under Transparency act no
grievances are redressible but where two contraries informations have
been made available by two SPIOs then information made available
becomes non authentic which can only be redressed by information
commission. 9-It is submitted before the Hon'ble Sir
that since D.P.R.O. manipulated date 31.5.2006 into 31.5.2007 in
public document to cheat your applicant which tantamount to serious
offence under I.P.C. so to conceal the fact , D.P.R.O. Mirzapur is
concting stories. This is humble request to you Hon'ble Sir to
pass appropriate direction to concern so that appropriate action must
be taken in accordance with the provision of transparency act. For
this your applicant shall ever pray you Hon'ble Sir. Yours
