Next part of submissions 7-It is submitted before the
Hon'ble Sir that subsection 3 of section 6 of R.T.I. Act 2005 states
that in case information sought from a public authority is held by
another public authority or subject matter is more closely connected
with the another public authority , then former transfers the
application or such part of it as may be appropriate to latter. 8-It
is submitted before the Hon'ble Sir that your complainant sought
information from D. M. Mirzapur not from executive engineer, jal
nigam, Mirzapur. Therefore demand of I.P.O. of Rs. 10.00 on the part
of excutive engineer , jal nigam , Mirzapur is illegal. The demand is
ultravires to the provisions of R.T.I. Act 2005.
9-It is submitted before the Hon'ble Sir that matter is concerned
with the scam in the installation of public hand pumps and rebore in
Block-Chhnbey as published in the leading news paper Amar Ujala in
Mirzapur news dated 8 may 2010 and D. M. Mirzapur is the supreme
monitoring body under whose supervision developmental activities are
carriedout at district level so D.M. is most accountable person and
she can't overlook her statutory liability. 10-It is submitted before
the Hon'ble Sir that in order to bringh transparency, D. M. Mirzapur
should have directed to PIO to made available information as desired
by complainant instead aforesaid letter to department against which
allegations have been made. Ipsofacto obvious that irk-some delay is
being made to frustrate your complainant as well as to screen the
offenders. This unhealthy practice has been common to our society
which is great obstacle in the smooth running of democratic process in
the country. All constructive efforts of government is going in vein.
This humble request of your complainant to
Hon'ble Sir that in view of complainant, concerned matter may tarnish
the image of bureaucratic setup which is not in favour of healthy
democracy. Therefore the need of hour is to direct proper authorities
to function in accordance with the law and appropriate order may be
issued against law breakers. For this your complainant shall ever pray
you Hon'ble Sir. Dated 5.8.2010 It is submitted before the
Hon'ble Sir that if allegation is made against any reputed institution
,then it comes forward to refute those allegations publicaly and
transparently but the act of D. M. Mirzapur is throughout negative and
seemed shielding the erring staff during the entire episode of
bungling of public fund. The core issue is sought information is still
awaited. This is humble request to you Hon'ble Sir to
take some steps as required by law in order to get the blessings of
